By placing an order with Wendy’s Cake Art LLC, you acknowledge that you have read, understood, and agreed to all of the above terms and conditions.
Wendy’s Cake Art LLC — Official Business Policies
1. Deposits and Order Availability
Once it is confirmed that your date is available, you will be required to place a non-refundable deposit equal to 50% of your total cake cost.
Orders are accepted on a first-come, first-served basis.
We accept a limited number of cakes per week to ensure quality and service.
2. Right to Refuse Orders
We reserve the right to close our books or decline any order for any reason at our discretion.
3. Final Payment
The remaining balance must be paid no later than two (2) days before delivery or pickup.
Cakes will not be delivered or released without full payment.
4. Order Cancellation by Wendy’s Cake Art
We reserve the right to cancel any order and refund your deposit in full at any time if necessary.
5. Changes to Orders
All changes to cake size (of equal or higher value), style, or flavors must be made no later than five (5) days before the event.
Changes requested after this date cannot be guaranteed and may incur additional charges.
6. Event Date Changes
If your event date changes, we will do our best to accommodate a new date if availability allows.
Alternatively, we may issue a credit for a future order of equal or greater value, valid for six (6) months.
Date change requests must be made at least five (5) days prior to the event.
7. Cake Setup and Responsibility
We are not responsible for any damage to the cake once setup is complete.
It is your responsibility to provide a stable, level table and maintain an appropriate environment (75°F or below).
Cakes are heavy and require sturdy support.
If there are any issues, please contact us immediately before accepting the cake.
8. Customer Pickup
If you or your representative choose to pick up and transport the cake, you assume all liability and responsibility for the condition of the cake once it leaves Wendy’s Cake Art LLC’s possession.
9. Delivery and Delays
We offer delivery for an additional fee based on distance.
While we always strive to be punctual, delivery times cannot be guaranteed due to traffic or unforeseen conditions.
Delivery hours:
- Monday through Friday: Deliveries are typically made after 6:00 PM.
- Earlier deliveries may be available upon request but are not guaranteed.
- We also offer late-night deliveries for certain events (e.g., clubs).
You are responsible for being present at the delivery location at the agreed time.
If the driver must leave to complete other deliveries, a second delivery attempt will incur an additional charge.
10. Ganache Under Fondant
All fondant cakes are coated with either white or dark chocolate ganache underneath.
It is the customer’s responsibility to inform us if you have a preference between the two.
11. Allergens
Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens.
By placing an order, you agree to notify your guests of these potential allergens and hold Wendy’s Cake Art LLC harmless for any allergic reactions.
12. Photos and Progress Updates
We do not provide progress photos or images of cakes during production or before delivery.
Our focus is on creating your order, and we may be working on multiple cakes simultaneously.
Additionally, cakes may not appear complete until all final decorations are assembled, so partial progress photos are not representative of the final product.
13. Artistic License and Design Interpretation
All cakes are custom-made and crafted by hand. While we make every effort to match requested designs, colors, and styles, slight variations may occur due to the artistic nature of our work, ingredient availability, or structural needs.
Wendy’s Cake Art LLC reserves the right to make minor design adjustments if necessary for stability, aesthetics, or safety.
14. Non-Edible Decorations and Supports
Some decorative elements (such as dowels, wires, foam, or internal supports) may be non-edible and must be removed before serving.
Wendy’s Cake Art LLC is not responsible for injury or damage caused by the consumption or mishandling of these supports.
15. Cake Storage After Delivery or Pickup
Once the cake has been picked up or delivered, the customer is responsible for proper storage.
- Fondant cakes: Keep in a cool, air-conditioned space (not refrigerated) until serving.
- Buttercream cakes: Refrigerate and bring to room temperature before serving.
We are not responsible for damage resulting from improper storage, temperature changes, moisture, or movement after delivery or pickup.
16. Photography and Marketing Rights
Wendy’s Cake Art LLC reserves the right to photograph all cakes and use these images for marketing, advertising, and portfolio purposes (online or in print).
We will never share or disclose personal or event information.
17. Chargebacks and Disputes
In the event of a payment dispute or chargeback, the customer agrees to first contact Wendy’s Cake Art LLC to resolve the issue directly.
Any disputes must be submitted in writing within 48 hours of delivery or pickup.
Once the cake has been accepted, it is considered satisfactory and delivered as agreed.
18. Force Majeure (Unforeseen Circumstances)
Wendy’s Cake Art LLC is not liable for failure to complete an order due to circumstances beyond our control, such as accidents, illness, extreme weather, power outages, or transportation issues.
In such cases, we will issue a full refund or credit toward a future order.
19. Agreement
